1. INTRODUCTION
This document aims to regulate the TERMS or GENERAL CONDITIONS OF CONTRACTING the online reservation services (hereinafter, interchangeably, the online reservation services or the Services) of HOTELS & RESORTS BLUE SEA MANAGEMENT, S.L., and its subsidiaries listed in Annex 1, with registered office at Calle Gremi fusters 33, planta 2, oficina 23, 07009 Palma de Mallorca, constituted for an indefinite period registered in the Mercantile Registry of Palma de Mallorca, in Volume 2544, Folio 168, Sheet PM-72291, and is provided with N.I.F. number B-57.81.72.15, (hereinafter, "BLUE SEA" or "BLUE SEA GROUP"), Tel. 971 427 110.
The terms "You" and "User" are used here to refer to all individuals and/or entities that for any reason access www.blueseahotels.com or use the services.
The use of these services will imply full and unreserved acceptance, and validity, of each and every one of the Terms and/or General Conditions - which will be considered automatically incorporated into the contract signed with BLUE SEA, without the need for their written transcription in the same - contained in the latest updated version of these Terms and/or General Conditions.
2. USE OF BLUE SEA ONLINE RESERVATION SERVICES
2.1 Online Reservation Services
a. The online reservation services aim to reserve a room in any of the BLUE SEA hotels. The use of these services will imply full and unreserved acceptance, and validity, of each and every one of the Terms and/or General Conditions - which will be considered automatically incorporated into the contract signed with BLUE SEA, without the need for their written transcription in the same - contained in the latest updated version of these Terms and/or General Conditions.
b. Contracting procedure: When using the service, the user will receive a confirmation email that will include confirmation that their purchase order is in the confirmation process. If you are a consumer, once the corresponding charge for your reservation is made, you will receive an email confirming it; this email serves as proof of your reservation.
c. Guarantee: The reservation is confirmed and guaranteed for the entire night with a credit card. If you do not show up at the hotel without prior notice, the first night will be charged (VAT/IGIC and taxes included).
d. Termination of the contract or cancellation of the reservation: The credit card is only a means of guarantee. The cancellation of reservations by the user will not incur early cancellation costs, as long as it is done before the deadline established in each hotel (local hotel time) on the day of arrival. After this threshold, BLUE SEA will charge as compensation the cancellation costs, which will amount to the cost of the first night (VAT/IGIC and taxes included).
This clause is not valid for reservations made with special rates. In this case, the respective established conditions will apply.
e. Cancellation costs at BLUE SEA hotels.
- The total amount of your credit card will be charged if the cancellation is made after the reservation has been made.
- In case the client does not show up at the hotel without prior notice, 100% of the total cost of the stay will be charged.
- In case you need to make any modifications or cancel the reservation, the penalty will be 100% of the total cost of the stay.
These clauses are not valid for reservations made with special rates. In this case, the respective established conditions will apply.
f. Minors policy.
Minors under 18 years of age must stay in the Hotel accompanied by their parents, guardians, or adults duly authorized by them. The Hotel staff may require pertinent documentation identifying the adults as their parents/guardians or authorized persons.
In the event that minors engage in activities not supervised or directed by Hotel staff, it will be the responsibility of the parent/guardian/legal guardian to supervise the minor at all times, being directly responsible for any possible damages the minor may suffer or cause, in cases where the activity has not been organized or supervised by Hotel staff.
g. Prices per room and night.
The prices are only valid in writing and for the period indicated. When there are justifiable reasons, BLUE SEA reserves the right to modify these rates without prior notice.
The prices related to the reservation will be indicated during the reservation process. VAT/IGIC applies to the prices, without prejudice to the fact that additional taxes may also apply in accordance with local regulations in each of the countries. The aforementioned local taxes must be paid directly at the hotel.
h. The prices shown at the time of booking include VAT/IGIC (or the equivalent tax) according to the applicable tax rate at the time.
In case the tax rate changes between the date of the reservation and the date of service delivery, generating a disparity, in accordance with tax regulations, the tax rate that will apply to the final price will be the one in effect at the time of service delivery or tax accumulation, even in cases where this causes an increase in relation to the final price indicated to the client during the reservation. The total amount will be charged at the time of booking.
2.2 Conditions of the reservation made at BLUE SEA
• The charge will be made in euros.
• The currency conversion amount is for informational purposes only, it may vary.
• Blue Sea rates do not allow changes or cancellations.
• The tourist tax is not included.
• Pets are not allowed, except at the Blue Sea Callao Garden Hotel).
2.2. The check-in time at Blue Sea portfolio Hotels, which can be found at https://www.blueseahotels.com/hoteles-bluesea, is between 2 PM and 4 PM
The check-out time is between 11 AM and 12 PM.
2.3 The user agrees to use the services in accordance with the Law, morality, good customs, and public order, as well as with the provisions of these General Terms and/or Conditions of contracting. Consequently, they are obliged not to use the services for illicit purposes and/or contrary to the provisions of these General Terms and/or Conditions of contracting, harmful to the rights and/or interests of third parties or that, in any way, may damage the services, BLUE SEA and/or its image.
2.4 BLUE SEA may, for greater agility and for the benefit of users, unilaterally modify, at any time and without prior notice, the services provided, or the operating, technical, and use conditions of the services. Likewise, users, in order to improve the service and establish an optimal level of quality, the ultimate goal of BLUE SEA, may suggest those modifications they deem useful, contacting the page managers through the email address: dpo@blueseahotels.es
3. DATA PROTECTION
This section presents information about the processing of your data in relation to making reservations.

FOR WHAT PURPOSE WILL BLUE SEA PROCESS THE HOLDER'S PERSONAL DATA AND FOR HOW LONG?
We inform you that the data provided by the account holder is processed by BLUE SEA for the following purposes:
- Managing the reservations requested by the user.
- Sending confirmation or documentation of the reservation made.
- In the event of consent for this, sending commercial communications by BLUE SEA GROUP.
WHAT USER DATA WILL BLUE SEA PROCESS?
For the correct provision of the services, BLUE SEA will process the following categories of data:
• Identification data: name, surname, nationality.
• Contact data: email address, phone number.
• Data on the transaction of goods and services at BLUE SEA: Products and services purchased or shown interest in.
• Accommodation preferences.
• Economic, financial, and insurance data.
• Other data: data provided by the interested parties in open fields.
The data requested from the Holder is mandatory for the correct provision of the services and, therefore, the refusal to supply them will make it impossible to provide them. In cases where non-mandatory data is requested, it will be indicated on the same form.
In the event that the user provides third-party data, they declare having the consent of the same and undertake to transfer the information contained in the Privacy Policy to them, exempting BLUE SEA from any liability in this regard. However, BLUE SEA may carry out periodic checks to verify this fact, adopting the corresponding due diligence measures, in accordance with data protection regulations.
WHAT IS THE LEGITIMATION FOR THE PROCESSING OF USER DATA?
The legitimacy for the processing of your personal data will be the execution of the contract between the parties. In the case of sending commercial communications, it will be the consent of the holder. The consents obtained for the mentioned purposes are independent, so the user may revoke only one of them without affecting the others.

WITH WHOM WILL USER DATA BE SHARED?
The user's data may be communicated to:
Companies integrated or adhered to the BLUE SEA Group, all dedicated to the hotel sector, will need access to your data for the correct provision of the selected services. Likewise, your data will be communicated to those entities that own the hotels, so that they know the conditions of your stay (price, dates, services included, ...), some of which may be located outside the European Economic Area, even in countries that do not offer a level of protection equivalent to Spanish law) for the sole purpose of being able to provide the services correctly.
DATA RETENTION
The personal data provided will be retained during the contractual relationship and, once it is finished, during the period of prescription of the legal actions that may arise from it.
Regarding the data for sending commercial communications, the data will be retained as long as the user does not revoke the given consent. However, if you withdraw your consent, it will not affect the legality of the processing carried out previously.
PROCESSING OF THIRD-PARTY DATA
If the Holder provides, at any time, third-party data, they declare having the consent of the same and undertake to transfer the information contained in this clause to them, as well as to inform BLUE SEA of any change or update related to them.
RIGHTS OF HOLDERS REGARDING THEIR DATA.
You can exercise, by writing to the email address dpo@blueseahotels.es with the Reference "Data Protection", attaching a photocopy of your identity document, at any time and free of charge, the following rights:
1. Revoke your consent for the processing and communication of your personal data.
2. Obtain information on whether or not your personal data has been processed.
3. Access your personal data.
4. Correct incorrect or incomplete data.
5. Request the deletion of your personal data when, for some reason, the data is no longer necessary for the purposes for which it was obtained.
6. Limit the processing of your data when any of the conditions established in the data protection regulations are met.
7. Under certain circumstances, and for reasons related to your personal situation, the interested parties may object to the processing of their data.
8. Request the portability of your data.

4. CORRECT USE OF THE WEBSITE CONTENT BY THE USER
4.1 BLUE SEA declares that the industrial property rights (trademarks, trade names, etc.) appearing on this Website are its property and/or are legitimately exploited under agreements or licenses of use, being duly protected by the existing Industrial Property Regulations. The User is obliged to use the Website diligently, correctly, and lawfully, and in particular, undertakes to refrain from:
a) Deleting, eluding, or manipulating the "copyright", trademarks, and other identifying data of BLUE SEA's rights or their owners incorporated into the content and/or products marketed from BLUE SEA's Website, as well as the technical protection devices, digital fingerprints, or any information mechanisms that may be contained therein.
b) Using the content and, in particular, BLUE SEA's information obtained through its Website to send advertising, communications for direct sales purposes, or for any other commercial purpose, unsolicited messages directed to a plurality of people.
c) Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the content, unless authorized by the holder of the corresponding rights or it is legally permitted.
d) In general, using the content in a way, for purposes, or effects contrary to the law, morality, generally accepted good customs, or public order. BLUE SEA does not grant any license or authorization for use of any kind over its industrial and intellectual property rights or over any other property or right related to its Website.
4.2 Procedure in case of intellectual property rights violation. In the event that any User or third party considers that any of the content has been introduced into its Website with a violation of their intellectual property rights, they must send a notification to BLUE SEA with a complete and precise indication of their data and the intellectual property rights supposedly infringed as well as the Website.
5. RIGHT TO MODIFY THE TERMS AND/OR GENERAL CONDITIONS OF CONTRACTING
BLUE SEA reserves the right to modify these Terms and/or General Conditions of contracting, informing users of the changes made through www.blueseahotels.com.
6. EXCLUSION OF WARRANTIES AND LIABILITY
6.1 BLUE SEA DOES NOT GUARANTEE THE RELIABILITY, AVAILABILITY, OR CONTINUITY OF THE SERVICES MADE AVAILABLE TO THE USER, THEREFORE, IT EXCLUDES ANY LIABILITY FOR DAMAGES THAT MAY BE DUE TO THE LACK OF AVAILABILITY, RELIABILITY, OR CONTINUITY OF ITS WEBSITE OR ITS SERVICES, ALTHOUGH IT WILL ATTEMPT TO FACILITATE, AS FAR AS POSSIBLE, TECHNICAL ASSISTANCE TO THE AFFECTED PERSON, AS WELL AS ATTEMPT TO IMMEDIATELY REESTABLISH THE INTERRUPTION, PROVIDING, AS FAR AS POSSIBLE, ALTERNATIVE MEANS.
6.2 BLUE SEA IS NOT OBLIGED TO CONTROL AND DOES NOT CONTROL, PRIOR TO THE ABSENCE OF VIRUSES OR ELEMENTS IN THE CONTENT THAT MAY PRODUCE ALTERATIONS IN THE SOFTWARE OR HARDWARE OF USERS OR VISITORS OF THE PAGES, THEREFORE, IT WILL NOT BE LIABLE FOR DAMAGES OF ANY NATURE THAT MAY RESULT FROM THEM.
6.3 IF BLUE SEA, DESPITE ACTING WITH DUE FORESIGHT AND DILIGENCE, COULD NOT PROVIDE THE CONTRACTED ROOMS FOR REASONS NOT IMPUTABLE TO IT AND IF THERE IS IMPOSSIBILITY OF PROVIDING THE SERVICES UNDER THE AGREED CONDITIONS, BLUE SEA WILL OFFER THE USER THE POSSIBILITY OF OPTING FOR A FULL REFUND OF THE AMOUNT PAID OR FOR ITS REPLACEMENT BY ANOTHER OF SIMILAR CHARACTERISTICS IN TERMS OF CATEGORY OR QUALITY. IF THE REPLACEMENT RESULTS IN A LOWER CATEGORY OR QUALITY SERVICE, BLUE SEA WILL REFUND THE DIFFERENCE.
7. SAFEGUARDING OF THE TERMS AND/OR GENERAL CONDITIONS OF CONTRACTING
If any of the stipulations of these Terms and/or General Conditions of contracting were declared null or inoperative, the rest of the Terms or General Conditions will remain as agreed. BLUE SEA undertakes to replace the stipulation affected by the nullity as closely as possible to the original intention pursued by the parties. NO STIPULATION IN THIS CONTRACT WILL IN ANY WAY AFFECT THE IMPERATIVE PROVISIONS IN CONSUMER MATTERS. IF YOU ARE NOT A CONSUMER, YOU EXPRESSLY WAIVE YOUR RIGHT OF WITHDRAWAL.
8. WWW.BLUESEAHOTELS.COM AND ACCEPTANCE OF TERMS OF USE
The user is aware that the use of the online reservation services implies full and unreserved acceptance of each of the clauses forming part of the Terms of Use of www.blueseahotels.com, in the version published by BLUE SEA at the time the user contracts the service. These terms of use complete these General Terms or Conditions in all that they do not oppose. Therefore, the user must be aware of the importance of consulting the rules of this page before accessing and/or using these services.

9. APPLICABLE LAW AND COMPETENT JURISDICTION
These Terms and/or General Conditions of contracting are governed by Spanish Law. BLUE SEA and the users, for the resolution of any controversy that may arise, with respect to their validity, execution, compliance, or resolution, in whole or in part, submit, with express waiver of their own jurisdiction or any other that may correspond to them, to the competence of the Courts and Tribunals of Palma de Mallorca. This contract constitutes the complete and entire expression of the agreement between BLUE SEA and the user, and replaces all previous agreements, commitments, representations, or agreements, whether written or oral, that have existed previously between both.
In all cases, any controversy arising from the provision of services in the hotel where the client is staying will be submitted to the consumer courts.
The company has the right to modify unilaterally, anytime, and without previous notice these conditions. In that case, the new modifications will be published and announced in advance as much as possible. In any case, they have to change the web and its configuration unilaterally, anytime, and without previous notice.
This Legal notice is only valid for the website and its contents owned by the company, and are not applicable to third parties’ hyperlinks or websites accessible through the webpage. The company is not responsible for the content of any of the linked webpages, nor for any link included within a webpage accessible through the company’s website.
The content of this webpage is exclusively owned by the company, and, for expository purposes, not limitative, the graphic design, source code, logos, texts, graphics, illustrations, photographs, and any other element that appears in the webpage. Likewise, any trade name, brands or distinctive signatures of any sort contained in the website are protected by the intellectual and industrial property law. The following terms are governed by the Spanish legislation, which will be applicable in anything not stated in this contract as a way of interpretation, validity, and execution. Both parts renounce expressly to any other jurisdiction and submit expressly to the Juries and Tribunals of Palma de Mallorca to solve any controversy that may happen in the interpretation or execution of these contractual conditions.
Conditions of Reservation
A credit card will be required as a reservation guarantee.
Check-in time is between 2 PM and 4 PM
The currency conversion amount is for informational purposes only and may vary.
No pets are allowed (only in BLUESEA Callao Garden).
The establishment reserves the right to cancel the reservation if any error is detected in the dates or rates of the reservation.
Pay at the Hotel:
• Taxes included.
• Direct payment upon arrival at the hotel, by credit card (Amex, Visa, Mastercard) or cash up to 1000€ (200€ and 500€ notes not accepted).
• Cancellation policy: free up to 6 days before the arrival day. For late cancellation, the first night will be charged, and if you do not show up at the hotel, the entire stay will be charged.
• Tourist tax not included.
Non-Refundable Rate:
• Taxes included.
• The total amount will be charged at the time of booking. The charge will be made in euros.
• This rate does not allow changes or cancellations.
• In case you need to make any modification or cancel the reservation, the penalty will be 100% of the total amount of the stay.

I. IDENTITY OF THE SELLER.
The Seller of the services contracted by the user is the entity Hotels & Resorts Blue Sea Management, S.L., which is a company that provides hotel accommodation services.
The website www.blueseahotels.com is registered in the name of Hotels & Resorts Blue Sea Management, S.L. The trademark is duly registered in the name of the entity.
II. PURPOSE OF THE CONTRACTING CONDITIONS.
The purpose of these contracting conditions is to set the terms for the sale and/or reservation of services to be contracted through the website www.blueseahotels.com The conditions will regulate the contractual relationship of sale/reservation of hotel accommodation generated between the Seller and the Buyer at the moment the latter accepts the corresponding box during the online purchase process. The characteristics of the contracted services are reflected on the corresponding pages of this website, as well as the details of each transaction that may be carried out in this environment, always in Spanish.
The contracting of any of the services and/or products by the buyer through the website www.blueseahotels.com implies acceptance and adherence to these General Terms of Sale in their entirety.
The company provides reservation and/or sale of hotel accommodation services through the website, always offered by the entity Hotels & Resorts Blue Sea Management, S.L. This reservation and/or sale of hotel accommodation will be governed by the Contracting Conditions set forth herein and by the Specific Conditions that may apply to each of the products and services offered.
The prices applicable to the contracted products and/or services are those indicated on the website on the date of reservation and/or contracting. The offers will be duly marked and identified as such, conveniently indicating the previous price and the offer price.
All means and technical requirements needed to access the page, the website, and the services and/or products offered therein will be the sole responsibility of the User, as well as any expenses or taxes that the provision of such services may give rise to.
Once accessed, and in order to use the various services, the User must follow all the indications and instructions set forth on the Website, completing for these purposes the Specific Conditions and other forms established for each service, which will imply the reading and acceptance of all the General Contracting Conditions, as well as, where appropriate, the Specific Conditions that may be applicable.
III. PURCHASE AND/OR RESERVATION PROCEDURE.
The contracting of services must be done through the specific selection of the desired type of accommodation, using the purchase and/or reservation selection tools installed on the website.
Once the purchase and/or reservation request has been selected and verified, you will have expressly accepted all of the general conditions as shown on the company's website prior to the acquisition of the requested services.
From the moment of acceptance, the user acquires the status of Client of the company described in these General Conditions. Any of the services, products, and/or reservations subsequently offered by the company must be subject to a new contract.
It is recommended that the user/client read these General Conditions more carefully and print the document on paper or save it in electronic format.

(hereinafter, "HRBS"), with C.I.F. (i) Managing your reservation and providing the contracted accommodation service, including payment management (if applicable) and managing your requests and preferences, as well as handling your contact requests with HRBS through the channels provided for this purpose; all of this is necessary for the execution of the service provision contract that links us with our clients;
(ii) Managing surveys and/or evaluations related to the quality of the services provided by HRBS and/or your perception of HRBS as a company/hotel group, based on our legitimate interest in assessing your satisfaction, understanding your expectations, and improving the quality of our products and services;
(iii) Managing the sending of personalized commercial communications by electronic means, with information related to products, services, promotions, offers, events or news from the Blue Sea Group, relevant to our clients; all of this, solely and exclusively, according to (a) the data provided by them and (b) their stay and experiences with the Blue Sea Group. In no case will automated decisions be made based on this information.
In this last case, we consider that we have a legitimate interest in knowing our clients' preferences, in order to offer the services that best meet their needs and desires.
Notwithstanding the above, users who wish to unsubscribe from receiving commercial communications may do so at any time and at no cost by sending an email to the following address: dpo@blueseahotels.es, following the instructions specified later, in addition to following the instructions specified in each commercial communication.

The legal basis for processing customers' data for this purpose is the consent given by ticking the indicated box.
The personal data provided will be retained during the contractual relationship with our clients, as well as for the time necessary to fulfill the purposes indicated above or any applicable legal obligations.
In relation to the data for sending commercial communications, it will be retained as long as the clients do not revoke or object to the consent given. However, if you withdraw your consent, this will not affect the legality of the treatments carried out previously.
The Client's data may be communicated to: the companies participated in or affiliated with the HRBS group, related at the end of this Policy, solely for internal administrative purposes and/or for the aforementioned purposes, with the processing carried out by the mentioned companies, in any case, under the same terms, conditions, and guarantees as those set out in this Policy, which are hereby reproduced; HRBS providers or hotel operators necessary for the proper fulfillment of legal obligations and/or the aforementioned purposes; Partners and collaborating companies of the HRBS Group for the fulfillment of the aforementioned purposes and/or, if authorized, for sending commercial communications; and Public Administrations, in the cases provided by law.
The Client:
Guarantees that they are of legal age or legally emancipated, as the case may be, fully capable, and that the data provided to HRBS is true, accurate, complete, and up-to-date. To this end, the Client is responsible for the accuracy of all the data they provide.
Guarantees that they have informed third parties whose data they provide, if they do so, of the aspects contained in this document. Likewise, they guarantee that they have obtained their authorization to provide their data to HRBS for the purposes indicated.
Will be responsible for any false or inaccurate information they provide and for the damages, direct or indirect, that this causes to HRBS or third parties.
To exercise your rights, you can send the corresponding form duly completed, which can be found on the website of the Spanish Data Protection Agency ("rights") to HOTELS & Resorts Blue Sea Management, S.L., C/ Gremi Fusters 33, 07009 Palma de Mallorca, to the email address dpo@blueseahotels.es, with the reference "Data Protection".
In the event that HRBS deems it necessary to identify the clients, they may request a copy of a document proving their identity. In particular, regardless of the purpose or legal basis on which HRBS processes the clients' data, the latter have the following rights:
- Right of access: to obtain confirmation about what type of personal data of the clients we are processing, as well as access to the same.
- Right of rectification: to request the modification of personal data when it is inaccurate or to complete it when it is incomplete.
- Right of deletion: to request that personal data be deleted when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
- Right to limitation: to request the limitation of the processing of the data, in which case they will only be retained for the exercise or defense of claims.
